VowBloom respects intellectual-property rights. Because users can upload and import images, this policy explains how to report material you believe infringes your copyright, and how we respond, under the U.S. Digital Millennium Copyright Act (DMCA).
Reporting claimed infringement
If you believe content on VowBloom infringes a copyright you own or control, send a written notice to our Designated Agent that includes:
- your physical or electronic signature;
- identification of the copyrighted work you claim was infringed;
- identification of the material you claim is infringing, and enough detail for us to locate it;
- your name, address, telephone number, and email;
- a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner, or authorized to act on the owner’s behalf.
Our Designated Agent
Send notices to [DMCA DESIGNATED AGENT — name + email, must match Copyright Office registration], [LEGAL ENTITY — form an LLC/corporation: prerequisite A-1], [COMPANY POSTAL ADDRESS].
⚑ Attorney review — register this Designated Agent with the U.S. Copyright Office DMCA directory before relying on safe harbor, and make sure the contact here matches the registration exactly.What we do with a valid notice
When we receive a notice that satisfies the law, we will remove or disable access to the material and make a reasonable effort to notify the user who posted it. We may keep a record of the notice.
Counter-notification
If you believe your material was removed by mistake or misidentification, you may send our Designated Agent a counter-notification that includes your signature; identification of the material and where it appeared; a statement, under penalty of perjury, that you have a good-faith belief it was removed by mistake or misidentification; your name, address, and phone number; and your consent to the jurisdiction of the federal court for your district (or, if outside the U.S., a district where we may be found) and to accept service from the person who filed the original notice. We may restore the material as the DMCA permits.
Repeat infringers
We will, in appropriate circumstances, suspend or terminate the accounts of users who are repeat infringers.
